Nor are they transferable from year to year. Once you are signed up, race fees are used for race expenses and cannot be returned.

ASSUMPTION OF RISK
I understand that participation in the Event is voluntary and may include risks and dangers, including but not limited to: running or walking on public streets and pathways, weather conditions, uneven terrain, vehicle traffic, obstacles, crowding, and the actions of other participants, volunteers, staff, or third parties. I recognize that such risks may result in injury, illness, or, in rare cases, death. I knowingly and voluntarily assume all risks associated with my participation in the Event.

HEALTH & FITNESS
I represent that I am physically able and sufficiently trained to participate in a 5K (3.1 miles) and that I am in good health. It is my responsibility to consult with a medical professional before participating if I have any medical conditions, injuries, or concerns. I agree to immediately stop participating if I experience pain, dizziness, shortness of breath, or any other condition that makes continued participation unsafe. I understand that Event staff may remove me from the course if they determine that continued participation may be unsafe for me or others.

EVENT RULES & CONDUCT
I agree to follow all Event rules, safety instructions, course directions, and the guidance of StuyFitness/Beam Living staff, volunteers, marshals, and law enforcement. I will conduct myself in a safe, respectful, and responsible manner. I will not engage in unsafe, disruptive, or inappropriate behavior. I understand that failure to follow instructions may result in my removal from the Event.

WAIVER, RELEASE & INDEMNIFICATION
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless BPM MFNY Employer LLC d/b/a Beam Living ("Operator"), elitefeats, BPP PCVST Property Owner LLC, and each of their parents, affiliates, subsidiaries, officers, directors, employees, agents, contractors, volunteers, and representatives (collectively, the "Operator Parties") from any and all claims, suits, demands, causes of action, damages, or liability of any kind, including serious injury, death, or property damage, arising out of or in any manner related to my participation in the Event, including travel to and from the Event.

PERSONAL PROPERTY
I understand that the Operator Parties are not responsible for the loss, theft, or damage to my personal property during the Event, including items left at the start/finish area, along the course, or at any Event facilities.

EMERGENCY RESPONSE
In the event of an injury or medical emergency, I authorize Event staff to contact emergency medical services and to provide or arrange reasonable first-aid assistance as appropriate. I understand that I am responsible for any medical costs incurred on my behalf.

USE OF LIKENESS
I grant permission to the Operator Parties to use my name, image, photograph, and/or video recording taken during the Event for promotional, marketing, and other lawful purposes related to StuyFitness, Beam Living, and their affiliated properties, without compensation to me.

MISCELLANEOUS
This agreement shall be governed by New York law and shall be binding upon me and my legal representatives and assigns. If any part of this agreement is determined to be invalid or unenforceable, that part shall be severed and the remainder shall remain in full force and effect.

ACKNOWLEDGMENT & ELECTRONIC ACCEPTANCE
I acknowledge that I have carefully read and understand this Participant Waiver, Release of Liability & Assumption of Risk. I understand that by registering for and/or participating in the Event, I am giving up certain legal rights. I voluntarily agree to the terms of this waiver as a condition of participation in the Event.
